We (South Korea) must take the initiative on the North Korean Human Rights issue!


Kim Moon-soo, Member of the National Assembly October 17, 2004 The U.S. House of Representatives passed unanimously the NK Human Rights Act of 2004 on Oct. 4, 2004.


It took only 10 months since the North Korean Freedom Act was introduced on Nov. 20th and 21st in 2003 both at the Senate and the House, respectively, after a number of hearings by the Asia Pacific Subcommittee at the House.


The House passed the bill first on July 21st, and then the Senate passed the slightly revised bill on Sep. 28th, and finally the House passed the bill on Oct. 4th. All three times, it passed unanimously. It was expected that this bill would pass the Congress only after the presidential election, but it passed much earlier than expected. I believe the reason why the Congress passed the bill this quickly was that there had been loud outcry and concerns about the human rights situation in North Korea, from the American people.




In the first TV debate for the presidential election, the nuclear issue of
North Korea was a key debate issue. In the 90-minute debate, the candidates mentioned North Korea 30 times.


It is obvious now that the North Korean issue including the human rights issue has become an urgent common problem between the two candidates, and will be a top priority of the next Administration whoever may become the next president.


It is not just the U.S. The world community has expressed great concerns about the human rights situation in North Korea.


In 2003 and 2004, two years in a row, the UN Human Rights Committee passed the resolution warning about the human rights violations in North Korea.
It was not the U.S. but European Union who initiated the resolution.


According to the resolution, the UN appointed a special rapporteur, Professor Munthabon from Thailand to monitor the human rights conditions in North Korea. He will report to the UN General Assembly this year about the human rights situation of North Korea, and to the UN Human Rights Committee in March next year. It looks like the UN Human Rights Committee will put this issue again on its agenda and pass a resolution at its next conference.


However, our government and our National Assembly have not been with this international movement. For the reason we should not aggravate North Korea, our government decided not participate in 2003, and not to vote in 2004 on the resolution passed by the UN Human Rights Committee.
Furthermore, while the U.S. Congress was discussing and passing the NK Human Rights Act, 25 members of the Uri Party at the National Assembly delivered a letter to the U.S. Embassy in Seoul objecting the passage of the bill at the U.S. Senate. Recently, the Chairman and several other members of Uri Party publicly objected to the bill stating that the U.S. legislation would not improve the human rights condition in North Korea, while it only aggravates the NK regime.


Sure, we will have to consider the fact that this bill may aggravate the NK regime. Sure, we will have to consider the fact that this bill passed the U.S. Congress unanimously. However, we must honor and respect the spirit of the United Nations that the human rights supersede national sovereignty. If we ignore this basic principle, we will be isolated from the modern international community. Anyhow, how can we claim we are all brothers with North Koreans while we ignore the human rights violations in North Korea?
What is the unification for? If it were not for human rights, why do we need to unify with North Korea? It is the fascists approach against the time and against democratic principle that we can ignore the human rights of North Koreans for the purpose of unification at all costs.


We, the National Assembly and our government must take initiative addressing the human rights issue of North Korea. They are our brothers and our people. The more we suspect the U.S. can use the human rights issue to apply pressure to North Korea, the more we must get involved with this issue proactively and aggressively. How can we avoid or ignore the international tide for the human rights of North Korea!


It is high time that our government takes the initiative now. It is high
time that this National Assembly does something about the human rights issue. Only when our government and this Assembly take the initiative, we can work with the U.S. government and Congress, and guide and lead the international opinion according to our own goal and own pace.
