밀양 강정 주민, 노동자에게는 슬픈 날로 기억될 세계인권의 날
-인권박탈 정당화법. 그 자체로 차별
-인권의날 맞아 한국 인권상황에 심각한 우려

아시아 인권위원회가 세계인권의날을 맞아 밀양 사태에 관한 3차 성명서를 발표했다.

아시아 인권위원회는 10일 ‘SOUTH KOREA: Sad day to mark international human rights day for the villagers of Miryang, Gangjeong and the workers - 한국: 밀양과 강정의 주민 그리고 노동자에게는 슬픈 날로 기억될 세계인권의 날’이라는 홈페이지 성명서를 통해 밀양사태의 인권침해를 다시 지적하고, 사태가 악화되고 있음에 우려를 표명했다. 인권위는 송전탑 건설에 반대하는 주민들에게 가해진 협박과 폭행, 그리고 체포와 구금 등을 포함한 폭력 현상과 기준치에 미치지 못하는 원자력 발전소 부품들이 한국전력공사 관계자의 도움으로 위조되었음이 밝혀져 조사를 받는 상황에서도 송전탑 건설은 계속되고 있다고 지적했다.

성명서에서는 최근 음독자살한 유한석씨와, 작년에 분신자살한 이치우씨의 예를 들며 송전탑 건설과정에서 주민들의 요구가 무시되어, 문제해결을 위해 희생을 택할 수 밖에 없는 이유를 설명했다. 공공의 이익을 위해서라면 개인의 참여와 인간 존엄이 무시되는 사회, 그리고 어느 누구도 인간 존엄에 대한 근본적인 질문을 제기하지 않는 사회에 대해 비판의 소리를 냈다. 성명서는 법과 그 법의 집행자들에게 정책 결정에 의해 영향받는 사람들의 권리를 훼손하거나 제한하는 수단을 법의 이름으로 어느 선까지 사용할 수 있을지를 질문해보아야 하며 무엇보다도 인간의 존엄성을 존중해야 한다며 마무리 짓는다.

아시아 인권위원회의 3차 성명서는 심각한 인권탄압이 반복되는 상황에서 정부가 이를 해결하려는 노력을 보이지 않고 있으며, 인권 후진국으로 후퇴하고 있는 단면을 보여준다.

The situation in Miryang seems to have been deteriorating, which has shown by the phenomenon of violence in the area, including threats and harassment followed by arrest and detention against villagers who have protested against the construction of a 765 Kv power transmission tower. After two statements issued in this regard(vicarious administrative execution and discrimination, it was reported that many components needed for the construction of a nuclear power plant in fact have failed to meet the safety standards and their test results have been fabricated with the help of officials working at the Korea Electronic Power Corporation (KEPCO). Those officials involved in corruption are currently under investigation.

밀양 사태가 악화 되고 있음이 764 Kv 송전탑 건설에 반대하는 주민들에게 가해진 협박과 폭행, 그리고 이어서 벌어진 체포와 구금 등을 포함해서 그 지역에서 발생하는 폭력현상에서 나타나고 있다. 행정대집행과 차별에 관한 두개의 성명서가 발표된 후, 원자력발전소 건설에 필요한 많은 부품들이 안전기준치에 미치지 못하였으며 그 실험결과가 한국전력공사 (KEPCO) 관계자의 도움으로 위조되었음이 보고되었다. 이번 부정사건에 연관된 직원들은 현재 조사를 받고 있다.

Nevertheless, KEPCO has been continuing to construct power transmission towers. According to reports, Mr. YOO Han-Suk, (71) a villager who attempted to commit a suicide by taking a poison and who was hospitalised, died on December 6. Prior to his death when he became conscious, he had shared with his family members and rights activists his frustration of the power transmission tower that would have adverse effects on villagers, including himself. Early last year, Mr. Lee Chi-Woo, (74) also a villager who committed suicide by burning himself left a message, 'my death would have solved this problem'. These tragedies have severely affected entire villagers in the area.

그럼에도 불구하고, 한국전력공사는 송전탑건설을 지속적으로 해오고 있다. 보도에 다르면 음독자살 시도 후 병원에 입원했던 주민 유한석(71)씨가 12월 6일에 사망했다. 사망 전 의식을 회복하였을 때 가족과 활동가들에게 그는 송전탑이 자신을 포함한 마을 주민에 미치는 악영향에 대한 울분을 토로했다. 작년 초, 분신자살을 한 이치수(74)씨도 “나의 죽음이 이문제를 해결할 수 있을것이다” 라는 말을 남겼다. 이러한 비극들이 지역주민 모두에게 심각한 영향을 끼쳐왔다.

In order to prevent such tension that was expected by such a unilateral decision, the villagers had requested genuine consultations from both the government and KEPCO before construction. Together with civil society, they also provided alternative suggestions that would have avoided the possible tensions that might have occurred. However, their requests were ignored like the case of construction of navy base in Gangjeong village, Jeju Island. These two cases demonstrate that the principle of participation and human dignity in democratic society can be ignored in the name of public interest. However, no one has asked the fundamental question about human dignity.

일방적인 결정으로 예상된 갈등을 예방하기 위해 주민들은 송전탑 건설 이전 정부와 KEPCO측에 허심탄회한 협의를 요청했었다. 주민들은 송전탑 건설 과정에서 불거질 갈등을 예방하기 위해 시민사회와 함께 대안을 제시하기도 했다. 그러나 제주 강정 해군기지 건설 때와 마찬가지로 주민들의 요구는 무시됐다. 이 두 사례는 민주사회에서의 참여와 인간 존엄이라는 원칙이 공공의 이익이란 명분하에 무시될 수 있음을 보여준다. 그럼에도 그 어느 누구도 인간 존엄에 대한 근본적인 질문을 제기하지 않았다.

Utilitarianism argues the greatest happiness of the greatest number. Obviously it is not the case above. Unfortunately, many laws in the country have been introduced for such purpose without taking into consideration the feelings of others who are vulnerable or marginalised and thereby adversely affected by decisions or policies made. It is a basic principle in the democratic society that the affected have the right to participate in policy or decision making processes that may affect them. However, the law and its practice do not seem to care about them. It rather oppresses the workers. Twenty four workers and family members who committed suicide after the violent attack on them by the police, workers who are dismissed on the grounds of enjoying their rights and workers who died of leukaemia due to the company's failure to provide safety to their workers.

공리주의는 최대 다수의 최대 행복을 주장한다. 당연히 이것은 위에 든 사례엔 적용되지 않는다. 불행하게도 이 나라의 많은 법률이 사회적 약자 혹은 소외 계층에 속해 있어 정책이나 결정으로 인해 불리한 영향을 받는 사람들의 감정은 고려하지 않은 채 도입됐다. 이해당사자들이 자신들의 삶에 영향을 줄 정책을 만들거나 결정을 내리는 과정에 참여할 권리가 있다는 건 민주사회의 기본원칙이다. 그러나 현행법과 그 적용은 이들의 처지에 무관심한 것 같아 보인다. 오히려 현행법은 노동자들을 옥죄고 있다. 경찰의 무자비한 탄압 이후 24명의 노동자와 가족들이 스스로 목숨을 끊었는가 하면, 노동자들이 자신의 권리를 누렸다는 이유로 해고되고, 회사측이 안전을 확보해 주는데 실패한 탓에 노동자들은 백혈병으로 죽어갔다.

Now questions should be raised on how far those laws and their enforcers can use their means under the name of law undermining or limiting rights of people affected by policy or decision makers. What is the public interest? Who is the public? What is interest? How far can human rights be intruded upon in the name of public interest? Laws allowing or justifying deprivation of human rights are only the manifestation of discrimination in itself. But before this, we should first respect the dignity of human beings.

이제 '법과 법집행자들이 어느 선까지 정책 결정자들에 의해 영향받는 사람들의 권리를 훼손하거나 제한하는 수단을 법의 이름으로 사용할 수 있는가' 라는 질문이 제기돼야 한다. 대중의 이익이란 무엇인가? 대중이란 누구인가? 그리고 이익이란 무엇인가? 대중의 이익이란 이름 아래 어디까지 인권이 침해당할 수 있는가? 인권의 박탈을 허용하거나 정당화하는 법은 그 자체로 차별을 보여줄 뿐이다. 그러나 여기에 앞서 우리는 인간의 존엄성을 존중해야 한다.
